Recently we assisted a Mexican national with a strange problem. Our client had become a naturalized US citizen over 20 years ago but did not realize that the birth date on his certificate of naturalization was incorrect. When he lost his wallet and attempted to obtain replacement identification documents he realized the problem.
He filed two unsuccessful applications with USCIS to correct the mistake and each was denied. He hired our office to assist and we immediately filed a complaint in the US District Court to challenge the denials issued by USCIS. Throughout the process, the government did not want to correct the problem because the mistake was actually made by the individual who had listed the incorrect birth date on his application. Eventually we established that the government should have been aware of the error if it had properly reviewed the client’s file and today our client has a new certificate of naturalization with the correct date of birth. This client spent years attempted to resolve this situation and within a matter of months we successfully corrected his problem and got him the paperwork that he needed to move forward with his life.
